By accessing or using Lettrbase ("the Service"), operated at lettrbase.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. We reserve the right to update these Terms at any time, and your continued use of the Service constitutes acceptance of any changes.

2. Description of Service

Lettrbase is a newsletter lead discovery platform that helps users find, enrich, and export publicly available information about newsletters and their creators. The Service includes search functionality, data enrichment, lead management, export tools, and related features available through our web application.

3. Account Registration

To use Lettrbase, you must:

  • Create an account with a valid email address
  • Provide accurate and complete registration information
  • Be at least 18 years of age
  • Maintain the security of your account credentials

You are responsible for all activity that occurs under your account. Notify us immediately at support@lettrbase.com if you suspect unauthorized access.

4. Subscription Plans and Billing

4.1 Plans

Lettrbase offers free and paid subscription plans. Each plan includes specific usage limits for searches, leads, and features as described on our pricing page. We reserve the right to modify plan features and pricing with reasonable notice.

4.2 Billing

Paid subscriptions are billed monthly through Stripe. By subscribing to a paid plan, you authorize us to charge your payment method on a recurring basis. All fees are quoted in US dollars and are non-refundable except as required by law.

4.3 Cancellation

You may cancel your subscription at any time from your account settings. Upon cancellation, your subscription will remain active until the end of the current billing period. After that, your account will revert to the free plan.

5. Acceptable Use

You agree to use Lettrbase only for lawful purposes. You may not:

  • Use the Service to send unsolicited bulk email (spam) or violate anti-spam laws such as CAN-SPAM, GDPR, or CASL
  • Scrape, crawl, or use automated tools to extract data from our platform beyond normal use of our provided features
  • Attempt to access other users' accounts, data, or private information
  • Use the Service to harass, threaten, or harm any individual or organization
  • Resell, sublicense, or redistribute data obtained through the Service without authorization
  • Interfere with or disrupt the Service, its servers, or connected networks
  • Reverse engineer, decompile, or attempt to extract the source code of the Service
  • Use the Service in any manner that could damage, disable, or impair the Service

6. Data and Content

6.1 Your Data

You retain ownership of any data you upload or create within the Service, including your search configurations and notes. We will not access, use, or share your data except as necessary to provide the Service or as described in our Privacy Policy.

6.2 Newsletter Data

The newsletter and creator data provided through our Service is aggregated from publicly available sources. While we strive for accuracy, we make no guarantees about the completeness, reliability, or timeliness of this data. You are responsible for verifying the accuracy of any data before using it for outreach or business purposes.

6.3 Compliance

You are solely responsible for ensuring that your use of data obtained through Lettrbase complies with all applicable laws and regulations, including but not limited to data protection laws (GDPR, CCPA), anti-spam laws (CAN-SPAM, CASL), and any applicable industry regulations.

7. Referral Program

Lettrbase offers a referral program where you can earn credits by inviting others to the platform. Referral rewards are earned when a referred user subscribes to a paid plan. We reserve the right to modify or terminate the referral program at any time. Abuse of the referral program, including creating fake accounts or self-referrals, will result in forfeiture of rewards and potential account termination.

8. Intellectual Property

The Service, including its design, features, code, content, and branding, is owned by Lettrbase and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our Service without express written permission. Your use of the Service does not grant you any ownership rights in our intellectual property.

9. Limitation of Liability

To the maximum extent permitted by law, Lettrbase and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or related to your use of the Service. Our total liability for any claim related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or completely secure.

11. Account Termination

We may suspend or terminate your account at any time if you violate these Terms or engage in activity that is harmful to the Service or other users. You may delete your account at any time by contacting us. Upon termination, your right to use the Service will cease immediately, and we may delete your account data in accordance with our Privacy Policy.

12. Indemnification

You agree to indemnify and hold harmless Lettrbase and its officers, employees, and affiliates from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, or your violation of any third-party rights.

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
